Last  Will  of
John  Vernon,  deceased


          I,  John A. Vernon,  of Shelby County, Indiana do make and publish this my last Will and testament hereby, revoking all former wills by me made at any time.

          Item One.  I hereby direct that all my just debts and funeral expenses be paid by my executors, and that after paying all any said debts and funeral expenses I direct that my said executors shall purchase and erect a monument at the head of my grave.

          Item Two.  I direct that all my personal property shall be converted into cash and after paying all my just debts, funeral expenses, and the monument as provided in Item One, and after paying the expenses necessary in settling my estate, that the residue thereof, if any shall be divided among my heirs according to law. 

          Item Three.  I will and devise and bequeath to my beloved wife, Mary C. Vernon, for and during her natural life, all the real estate, wherever situate, of which I may died seized or possessed at the death of my beloved wife.  I direct that my said real estate shall be divided among my children and grand children as follows.
          To my son Orville D. Vernon the undivided one fifth (1\5) part in value thereof.
          To my daughter, Anna B. Moore the undivided one fifth (1\5) part in value thereof.
          To my son William H. Vernon the undivided one fifth (1\5) part in value thereof.
          To my son John E. Vernon the undivided one fifth (1\5) part in value thereof.
          To my Grand children, Nina Vernon, Olive Vernon and Mary Vernon, children of my son, Noah W. Vernon, deceased, the undivided one fifth (1\5) part in value thereof.

          Item Four.  I have made advancements to my said son, John E. Vernon as evidenced by notes held by me and I direct that the same as evidenced by said notes, together with interest therein be deducted from his said share in my estate.

          Item Five.  I hereby nominate and appoint my son Orville D. Vernon as my executor of this my last Will and Testament and direct that he shall honestly and economically settle my said estate.

          In testimony whereof I have hereunto set my hand and seal this 18" day of January 1906.

          Be It Remembered, That on the 12" day of December 1912 A. E. Lisher one of the subscribing witnesses to the within and foregoing last Will and Testament of John A. Vernon late of said County, deceased, personally appeared before Otto L. Coyle, Clerk of the Circuit Court of Shelby County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows, that is to say; That on the 18" day of January 1906 he saw the said John A. Vernon sign his name to the said instrument in writing as and for his last Will and Testament, and that this deponent at the same time heard the said John A. Vernon declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time at the request of the said John A. Vernon and with his consent attested and subscribed by the said A. E. Lisher, J. W. Worden in the presence of said testator and in the presence of each other as susbscribing witnesses thereto and that the said John A. Vernon was at the time of the signing and subscribing of said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not.

          I, Otto L. Coyle Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of John A. Vernon has been duly admitted to probate and duly proved by the testimony of A.E. Lisher one of the subscribing witnesses thereto, that a complete record of said Will and of the testimony of the said A.E. Lisher in proof thereof has been by me duly made and recorded in Book 6 at pages 243-244-245 of the record of Wills of said County.

          In Attestation Whereof, I have hereunto subscribed my name and affixed the seal of said Court at Shelbyville this 12" day of December 1912.

Codicil of the Will of John A. Vernon 

          I, John A. Vernon do make and publish this codicil to this my last Will and Testament above written. My son William H. Vernon having died since the making and executing of my above will. I will devise and bequeath to my grand children Ray Vernon, Merit Vernon, Anna Vernon and Arthur Vernon children of my deceased son William H. Vernon, the undivided one fifth (1\5) part in value of my estate the same that my son would have received had he lived. I have made advancements to my said son William H. Vernon of $150.00 and I direct that the same be deducted from the part that my said above named grandchildren shall receive.
          It is my will that should any of my said children, or grandchildren bring suit to contest my last will and testament above written and codicil to the same that the one so bringing said suit shall not receive any part of my said estate but that the share to said child or grand child shall go to my other children and grand children, share alike.
          I hereby revoke the appointment of my said son Orville D. Vernon as Executor and in his place I hereby appoint as Executor of this my last Will above written and codicil to the same, my beloved wife Mary C. Vernon. 
          Witness my hand and seal this 30" day of November 1912.
