Last Will & Testament
of
Catharine Johnson
To all whom it may concern: Know ye that I Catharine Johnson of Shelby County in the State of Indiana being of sound mind and memory do hereby make, ordain, publish and declare this to be my last will and Testiment --
That is to say
Item 1st
I give and bequeath to my son John Johnson a promisary note that I hold on him for one Thousand dollars -- dated June 22" 1868 due two years after date and signed John Johnson

I will, give and bequeath to my son Cyrus Johnson a promisary note that I hold on him for one Thousand dollars dated June 22" 1868 due Two years after date and signed Cyrus Johnson

I will, give and bequeath to my son James R. Johnson a promisary note that I hold on him for one Thousand dollars dated July 22" 1868, due Two years after date and signed James R. Johnson

I will, give and bequeath to my son George W. Johnson a promisary note that I hold on him for one Thousand dollars dated July 22" 1868, due Two years after date and signed George W. Johnson

I will, give and bequeath to my daughter Melissa Flint a promisary note that I hold on her and her husband John Flint for one Thousand dollars dated July 22" 1868, due Two years after date and signed Melissa Flint = John Flint

I will, give and bequeath to my daughter Belinda Adams a promisary note that I hold on her and her husband James M. Adams for one Thousand dollars dated July 22" 1868, due Two years after date and signed James M. Adams = Belinda Adams

I hereby authorize and direct my after named executor to deliver over to each of my children their note as above set forth it being my will, desire and intention that none of said notes shall ever be paid if my said children but be divided as herein directed.

That after all my lawful debts are paid and discharged the residue of my estate to be wqually divided between my children viz: John = Cyrus = James R. = George W. = Melissa Flint = Belinda Adams and the heirs of my deceased daughter Phebe J. Adams
" 9" I hereby make constitute and appoint Woram W. Woody and to be executor of this my last will and Testament.

I also authorize empower and direct my said executor to settle up all and everything connected with my said Estate in accordance with this my last will and Testaments without the aid of any court or legal proceedings whatever. James C Heart {{ seal }}

Be it Remembered that on the 6th day of April 1876, Hiram B. Cole one of the subscribing witnesses to the within and foregoing last Will and testament of Catharine Johnson late of said County deceased personally appeared before one Bellamy S Sutton Clerk of the Circuit Court of Shelby County in the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows, that is to say that on the 23rd day of January 1869 he saw the said Catharine Johnson sign her name to said instrument in writing as and for his last will and Testiment and that this deponent at the same Time heard the said Catharine Johnson declare the said instrument in writing to be her last will and Testiment and that the said instrument in writing was at the same time at the request of the said Catharine Johnson and with her consent attested and subscribed by the said Hiram B Cole and James C Hart in the presence of said testatrix and in the presence of each other as subscribing witnesses thereto and that the said Catharine Johnson was at the time of the signing and subscribing of said instrument in writing as aforesaid of full age (that is more than Twenty one Years of age,) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not.H. Sworn to and subscribed by the said deponent before me Bellamy S. Sutton Clerk of said court at Shelbyville the 6" day of April 1876.

I Bellamy S. Sutton clerk of the circuit Court of Shelby County Indiana do hereby certify that the within annexed Will and Testiment of Catharine Johnson has been duly admitted to probate and duly proved by the Testimony of Hiram B. Cole one of the subscribing Witnesses thereto that a coumplete Record of said will and of the Testimony of the said Hiram B. Cole, in proof thereof has been by me duly made and Recorded in book One at pages 438 & 439 of the Records of wills of said Court
