Last  Will  and  Testament
of
Kate Slusser,  Deceased.

I,  Kate Slusser,  of Shelbyville, of the County of Shelby and State of Indiana, do make this my last Will and Testament, hereby revoking any and all former Wills by me heretofore made.

Item 1.
          After the payment of all my just debts and the costs of the administration of my estate, the expense of my funeral and last sickness, I give and devise to my husband  Charles Slusser, Sr., and my daughter, Anna Louise Slusser, each a life estate in all my real estate, and I also give to my said daughter, Anna Louise Slusser the right to use so much of my real estate as may be necessary for her support and maintenance, and if necessary she may sell the same for said purpose, and the right and interest I have given to my said husband in my said real estate is subject and subordinate to the right of my said daughter, Anna Louise Slusser, to use said real estate for her support and maintenance and to sell the same for said purpose, if necessary.

Item 2.
          To each of my children, Charles W. Slusser,  Mary M. Nuckolls  and  George Albert Slusser, I give in fee simple, subject to the rights therein herein given to my said daughter Anna Louise Slusser and my husband, Charles Slusser, Sr, the one-fourth part of my said real estate, and the remaining one fourth I give in fee simple to the children of my son, William M. Slusser, they to hold the same share and share alike, subject to the rights therein herein given to my said daughter, Anna Louise Slusser and my husband, Charles Slusser, Sr.

Item 3.
          All the right I have given to my said husband, Charles Slusser, Sr., in my said real estate, I have given him in lieu of all his rights under the law in my estate.

Item 4.
          I hereby appoint my husband Charles Slusser, Sr., to be the executor of this will.

          In testimony whereof, I, Kate Slusser, have hereunto set my hand this 19th day of April, 1916.

Signed by testatrix, Kate Slusser, as her last will, in the presence of us, who, at her request, in her presence, and in the presence of each other, have hereunto subscribed our names as witnesses, this 19th day of april, 1916.

          Be it remembered, That on the 9 day of May, 1916 O. L. Williams one of the subscribing witnesses to the within and foregoing last Will and Testament of Kate Slusser late of said County, deceased, personally appeared before Cecil B. Collins, Clk. of the Circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath, declared and testified as follows, that is to say: That on the 19" day of April 1916 he saw the said Kate Slusser sign her name to the said instrument in writing as and for her last will and Testament; and that this deponent, at the same time, heard the said Kate Slusser declare the said instrument in writing to be her last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Kate Slusser, and with her consent attested and subscribed by the said O. L. Willams and Elizabeth E. Worland in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Kate Slusser was, at the time of the signing and sub-

scribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age), and of sound and disposing mind and memory and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

          I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Kate Slusser has been duly admitted to probate, and duly proved by the testimony of O. L. Williams one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said O. L. Williams in proof thereof, has been by me duly made and recorded in Book 7 at Pages 127-128 of the record of Wills of said County.

          IN ATTESTATION WHEREOF, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, this 9" day of May 1916.
