Last  Will  and  Testament
of
Lucy  T.  Ricketts


          I,  Lucy T. Ricketts,  of the City of Shelbyville, Shelby County, Indiana, being of sound and disposing mind and memory, do make, publish and declare the following to be my last will and testament, hereby revoking all former wills by me at any time made.

          Item 1.   I direct that all my just debts and funeral expenses be paid by my executor hereinafter named as soon after my death as practicable.

          Item 2.   I give, devise and bequeath all of my wearing apparel and personal adornments to my daughter, Willa Ricketts Hodell.

          Item 3.   All of the rest and residue of my property of every kind and description, and wherever situated, I direct shall be divided by my executor into two equal shares, one of which share I give, devise and bequeath absolutely and in fee simple to my daughter, Willa Ricketts Hodell, for her own use and benefit forever, or to her heirs or assigns.  The remaining share, one half of my estate, I give, devise and bequeath to my son-in-law, Charles W. Hodell, in trust, however, subject to the following uses and purposes, that is to say:

                    a.
I direct that my said trustee shall have the full and absolute and complete control and management of said property with full power to sell, invest and re-invest as complete as I might do if living.
                    b.
I direct that my said trustee shall keep said fund invested in such safe and prudent manner as his judgement may dictate and from the income derived therefrom to pay all taxes insurance and the expense of this trust and the net income remaining thereafter to be by said trustee paid in quarterly installments to my son, Albert Porter Ricketts  for and during his natural life.  Said payments to commence at the expiration of six months from the time my said trustee shall receive control of the funds and to be made thereafter every three months during the lifetime of my said son.
                    c.
Upon the death of my said son or if he be dead at the time of my death, leaving heirs of his body and such heirs being minors, I direct said trust shall continue during the minority of said heirs with like payments of income for their benefit until said heirs  SHALL  ARRIVE  AT  FULL  age, at which time, I direct that this trust shall cease and the property in the hands of said trustee be paid over to them, but if at the death of my son without heirs, or at my death if he should die before me, leaving no heirs, then and in either case I direct that the trust herein created shall cease and that all the funds in the hands of my said trustee shall be paid over to my daughter, Willa Ricketts Hodell, her heirs or assigns.
          Item 4.   I nominate and appoint my son-in-law, Charles W. Hodell, as the executor of this my last will and testament and I hereby authorize and empower my said executor, if he should think it wise and expedient, to make reasonable payments for the maintenance and support of my son, Albert Porter Ricketts, from my estate while in process of settlement and before the trust herein created shall start.

          IN  WITNESS  WHEREOF, I have hereunto set my hand and seal this 26th day of July, 1913.

          Be it remembered that on the 22nd day of January, A.D., 1919, the 15 judicial day of the January Term, of the Shelby Circuit Court in said year, come into open court Charles W. Hodell and produces in Court an instrument in writing purporting to be the last Will and Testament of Lucy T. Ricketts, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces Edward W. Lewis, one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say That on the 26th day of July, 1913, he saw the said Lucy T. Ricketts sign her name to said instrument in writing as and for her last Will and Testament; and that this deponent, at the same time, heard the said Lucy T. Ricketts declare the said instrument in writing to be her last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Lucy T. Ricketts and with her consent attested and subscribed by the said Edward W. Lewis and H. R. Buxton in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Lucy T. Ricketts was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

          Whereupon it is ordered, adjudged and decreed by the Clerk that said instrument in writing purporting to be the last Will of Lucy T. Ricketts deceased, is the last will and Testament of Lucy T. Ricketts deceased, and is hereby admitted to probate and record in this Court.

          I, Gordon Thurston, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed will and testament of Lucy T. Ricketts has been duly admitted to probate, and duly proved by the testimony of Edward W. Lewis one of the subscribing witnesses thereto, that a complete record of said will, and of the testimony of said Edward W. Lewis in proof thereof, has been by me duly made and recorded in Book 7 at pages 369 and 370 of the record of Wills of said County.

          IN  ATTESTATION  WHEREOF, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, Indiana this 22nd day of January 1919.
