Last Will and Testament of
Mary C.
Gates
I, Mary C. Gates, of Shelby County, Indiana, do hereby make and publish this as my last will and Testament.
Item 1. It is my will that all of my just debts, including expenses of my last sickness and funeral expenses and costs of settling my estate be paid.
Item 2. It is my will that my beloved daughter, Monta Harrod be well paid out of My estate for the care and attention she had given me and for nursing me in my afflictions.
Item 3. I hereby direct and it is my wil that the Executor of this my last Will shall sell and convert into cash all the property both real and personal ofwhich I may die the owners including my farm of thirty five acres situated in Bartholemow county, Indiana, and being the south part of the South west quarter of the north east quarter of Section Twelve (12) in township ten (10) north in range six (6) East; also the south part of the South East quarter of the North west Quarter of section twelve (12) in township ten (10) North in Range six east. (6)
Item 4. I give, devise and bequeath to my five beloved children, vis, - Sylvester C. Markland, Emma W. Smiley, and Monta Harrod, Else Markland, William W. Markland, each the one sixth part (1/6) part of the residue of my estate after the payment provided for in items one and two of this will shall have been paid and if any one shall be dead then his share to his children and I give, devise and bequeath to my beloved grandchildren, who are the children of my deceased daughter Lou Alta Barnett, vis, - Forrest Gates, Deasil Barnett and Ona Barnett the one sixth (1/6) part of the residue of my estate after the payment provided for in items one and two of this will shall have been paid share and share alike.
Item 5. I hereby revoke all former wills by me made.

Be it remembered that on the 12th day of February A.D., 1917, the 37th judicial day of the January Term of the Shelby Circuit Court in said year, come into open court Monta Harrod and produces in court an instrument in writing purporting to be the last will and testament of Mary C. Gates, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces Henry Stillabower the subscribing witness thereof, who being duly sworn by the clerk of said Court, on oath, declares and testifies as follows, that is to say: that on the 3rd day of May 1912 he saw the said Mary C. Gates sign her name to said instrument in writing as and for her last will and testament; and that this deponent, at the same time, heard the said Mary C. Gates declare the said instrument in wroting to be her last will and testament, and that thesaid instrument in writing was, at the same time, at the request of the said Mary C. Gates and with her consent attested and subscribed by the said Henry Stillabower and Ruth McKnight in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Mary C. Gates was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of fullage (that is, more than twenty one years of age) and of sound and disposing mind and
memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not. Henry Stillabower Sworn to and sbsceibed by the said Henry Stillabower before me Cecil B. Collins clerk of said Court at She lbyville Indiana, the 12th day of February 1917.

Whereupon it is ordered adjudged and decreed by the court that said
instrument in writing purporting to be the last will and testament of Mary C. Gates
deceased, is the last will and testament of Mary C. Gates, deceased, and is hereby admitted to
probate and record in this court.

I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana do hereby certify that the within annexed will and testament of Mary C. Gates has been duly admitted to probate and duly proved by the testomony of Henry Stillabower one of the subscribing witness thereto, that a completerecord of said will, and of the testimony of the said Henry Stillabower in proof thereof, had been by me duly made and recorded in Book 7 atpages213 and 214 of the record of Wills of said County.
IN ATTESTATION WHEREOF, I have hereunto subscribed my name and affixed the seal of said Court ar Shelbyville Indiana this12th day of February, 1917
