ary  L.  Treadway

          I,  Mary L. Treadway,  being of sound mind and disposing memory, do make and publish this my last will and testament.

          Item 1st.   I direct that all of my just debts, funeral expenses, and expenses of my last sickness be paid first.

          Item 2nd.   I give and bequeath to my daughter  Theodocia Carter, the oil painting picture of my deceased husband.

          Item 3rd.   I give and bequeath to my daughter  May Spurlin  the enlarged photograph of my said husband and the enlarged photograph of myself.

          Item 4th.   I give and bequeath to my daughters above named, share and share alike all of my jewelry and wearing apparel.

          Item 5th.   I give and bequeath to my granddaughter  Constance M. T. Heck , all the household and kitchen furniture owned by me at my death.  I also give and devise to my said granddaughter the house and lot where I now live in the town of Flat Rock, Shelby County, Indiana.

          Item 6th.   After the payments provided for In Item first, all personal property not herein before bequeathed shall be divided equally between my two daughters, above named.

          Item 7th.   I give and devise to my daughter Theodocia Carter, sixty acres of land by parallel lines off of the West side of the West half of the North East quarter of Section twenty one (21) township ten north of range six east.

          Item 8th.   I give and devise to my daughter May Spurlin all of the remainder of my real estate, situated in Flat Rock Township, Bartholomew County, Indiana, not herein otherwise disposed of.

In witness whereof I have hereunto set my hand this 27th day of March 1918.

          Be it remembered that on the 8th day of January, A. D., 1919, the 3d judicial day of the January Term of the Shelby Circuit Court in said year, come into open court W. H. Everroad and produces in court an instrument in writing purporting to be the last Will and Testament of Mary L. Treadway, deceased, and now Moves the admittance thereof of probate and record, and in proof of said Will introduces W. H. Everroad, one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say: That on the 27th day of March, 1918, he saw the said Mary L. Treadway sign her name to said instrument in writing as and for her last Will and Testament: and that this deponent, at the same time, heard the said Mary L. Treadway declare the said instrument in writing to be her last will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Mary L. Treadway and with her consent, attested and subscribed by the said W. H. Everroad and C. B. Cooper in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Mary L. Treadway was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint as the said deponent verily believes, and further deponent says not.

Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last will of Mary L. Treadway deceased, is the last will and testament of said Mary L. Treadway deceased, and is hereby admitted to probate and record in this Court.

          I, Gordon Thurston, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed will and testament of Mary L. Treadway has been duly admitted to probate and duly proved by the testimony of W. H. Everroad one of the subscribing witnesses thereto, that a complete record of said will, and of the testimony of the said W. H. Everroad in proof thereof, has been by me duly made and recorded in Book 7 at pages 367 and 368 of the record of wills of said county.

          IN  ATTESTATION  WHEREOF,  I have hereunto subscribed my name and affixed the seal of said Court, at Shelbyville Indiana, this 8th day of January, 1919.
