Will  and  Testament of
Robert  C.  Schoelch


I,  Robert S. Schoelch of Shelby County, Indiana, being of sound mind and disposing do make and declare this to be my Last Will and Testament hereby revoking any and all Wills hretofore by me made.

Item 1.   I desire that my executor by me herein after named pay all of my just debts including the debts of my lasst sickness and funeral expenses from the first moneys that come into his hands as such executor.

Item 2.   After complying with Item One (1) of this will the residue of my property of every kind and description including all real estate personal property and mixed that I may die seized I will desire and bequeath to my beloved wife Mary Schoelch for and during the term of her natural life.  She to have all the income from all real estate and personal property and to pay for the taxes and expenses of repairing and keeping property up from said income, and the costs of said trust.  It is my will further that should I die leaving real estate which my beloved wife and my executor herein after named, think would be to the best interest of my estate and for the best interest, comfort and support of my beloved wife to sell the same then I direct that my said Executor sell the same upon order of Court and reinvest the same for the best interests of my Estate and my said wife.

Item 3.   After complying with items One (1) and (2) of this will and after paying all just debts of my beloved wife Mary Schoelch then the property remaining of every kind and description I will devise and bequeath absolute and in fee simple to my three beloved children viz:  Russell William Schoelch,  Helen August Schoelch  and  Elizabeth Schoelch equally, share and share alike.

Item 4.   I hereby name and appoint my brother Henry Schoelch as the Executor of this my last Will and Testament.

Witness my hand and seal this 24th day of October 1908.

The foregoing Will was assigned and declared to be the Last Will and Testament by the above named Robert S. Schoelch in our presence and at his request was signed by us as witnesses in his presence and in the presence of each other. This October 24" 1908.

Be it Remembered That on the 17 day of August, 1911, Albert T. Wray, one of the subscribing witnesses to the within and foregoing last Will and Testament of Robert S. Schoelch late of said County deceased, personally appeared before me the Clerk of the Circuit Court of Shelby County in the State of Indiana, and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows, that is to say That on the 24 day of October, 1908, he saw the said Robert S. Schoelch sign his name to the said instrument in writing as and for his last Will and Testament and that this deponent, at the time, heard the said Robert S. Schoelch declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was, at the same time, at the request of the said Robert S. Schoelch and with his consent attested and subscribed by the said Albert T. Wray and Warren W. Townsend in the presence of said testator and in the presence of each other, as subscribing witnesses thereto, and that the said robert S. Schoelch was at the time of the signing and subscribing of said instrument in writing as aforesaid of full age (that is, more than twenty one years of age), and of sound and disposing mind and memory and not under any coercion or restraint, as the said deponent verily believes and further deponent say not.

I, Otto L. Coyle, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the here within annexed Will and Testament of Robert S. Schoelch has been duly admitted to Probate and hereby duly proved by the testimony of Albert T. Wray that a complete record of said Will and of the Testimony of the said Albert T. Wray in [-------] thereof has been by me duly made and recorded in Book 6 at Pages 46-47 to 48 of the record of the Will of said County.

In Attestation Whereof I have hereunto as aforesaid of full age (that is, more than twenty one years of age), and of sound and disposing mind and memory and not under any coercion or restraint, as the said deponent verily believes and further deponent say not.
