          One new complaint was entered in the circuit court here today.  Elias L. Gahimer  and  Harry Fox  name the Flat Rock Development Company and  Clarence C. Shipp  as defendants in this suit, in which they would collect $350 by foreclosure of a mechanic's lien.  Williams & Pell  and  W. A. Yarling  are attorneys for the plaintiffs.

          Mrs. Ozzro Fox, east of this city, was was operated on last Thursday at the Deaconess hospital in Indianapolis for gall stones and appendicitis, is getting along as well as can be expected under the circumstances, altho her condition is still very critical.  Mr. Fox will visit her bedside again Wednesday.

RESISTING  PROBATE  OF  WILL

Objections Filed by Mrs. Hattie Havens, Daughter of  Late Balser Fox.
------------
To Contest Will.
          Objections to the probate of the will of the late Balser Fox, of Brandywine township, who dropped dead at his home last Sunday morning, have been filed in circuit court by his daughter, Hattie O. Havens.  She alleges that a will is about to be presented for probate as the last will and testament of Mr. Fox and she urges that it is not his last will and testament and asks the court to declare it invalid and the probate refused.  She says her objections are made in good faith and not for the purpose of vexation and delay.  In offering objections to the will that is to be presented she alleges Mr. Fox was of unsound mind, that the will was unduly executed and that it was never executed by the deceased.  She charges that the signature to the pretended will was not made or signed by Mr. Fox, nor by any other person in his presence or at his request or with his knowledge or consent.  Mr. Fox left 160 acres of land and some personal property.  He has five heirs at law --- Mrs. Havens, Dora A. Kaster,  Harry B. Fox,  Walter Fox  and  Lottie Stewart.

SURPRISE  PARTY.
----------
          Mrs. Anna Fuchs,  of Union township, was very pleasantly surprised at her home Sunday in honor of her fortieth birthday anniversary, when about forty of her friends and relatives came in on her just before the noon hour with well-filled baskets of fine eats.  The surprise was a most complete one and the jolly crowd spent a most enjoyable day.

SUICIDE  STORY  AT  MORRISTOWN

          Morristown was thrown into a state of great excitement on Monday morning by the reported attempt at suicide of  John Fox, a resident of the second city of the county.
          About ten o'clock on Monday the report was current on the streets that John Fox had attempted to take his life by cutting an artery in his right wrist.  Mr. Fox is about forty-five years of age and has a family of three sons and a wife.  It was reported that he was worried over financial troubles and had been accused of forging notes.
          It is said that  W. H. Phillipi holds a note for $100 given him by Fox with  G. W. Copple  as security and which Copple says is a forgery.  This is street talk at Morristown and its truth is not vouched for.
          About ten o'clock Monday morning Fox was cutting weeds in the rear of his home and cut his right wrist on the scythe severing an artery and became very weak from the loss of blood.  This gave rise to the other stories and the report soon spread the Fox attempted to take his own life.
          Dr. Patton, of Morristown, attended the injured man and stated when interviewed by a Democrat representative Tuesday that the injury was the result of an accident and that the suicide stories were only street talk.  Mr. Fox is slowly recovering and a slight weakness from the loss of blood is the only result of the scare.

          Wm. V. Fox,  of Marion township, lost a very fine Norman mare Sunday.  On Saturday one of his boys rode the mare to a neighbor's and tied her to a palling fence.  Becoming frightened she attempted to jump the fence and was caught on the pallings, injuring herself so that she died.

Notice is hereby given that I will expose at public acution on Friday, the 16th of January, 1863, at the late residence of  Zeno Fox, (deceased,) in Marion Township, Shelby County, Indiana, all the personal property of said deceased not taken by the widow, consisting of Horses, Cattle, Sheep, Hogs, Wheat in the field, Corn in the crib, Household Furniture, Farming Utensils, &c.
          TERMS. --- A credit of 10 months will be given on all sums over $3, the purchaser giving his note as interest waiving valuation and appraisement laws, with approved security, sums of $3 and under cash in hand.
