Petition to sell real Estate

Shelby County February Term 1845

To the Judge of said court your memorialist Greenberry Davis Guardian of the person and estate of Richard Davis respectfully showeth that his said ward is the owner of certain real estate lying in said county of Shelby.  To wit a part of the East half of the South East quarter of Section Five in Township Thirteen North of Range Seven East bounded as follows.  To wit commencing at a point fifteen Rods East of the South West corner of said half quarter thence running East twenty one and two thirds rods thence North fifty three and two thirds rods; thence West twenty one and two thirds rods, thence South fifty three and two thirds rods to the place of beginning, containing seven acres and two ninth of an acre.  Your memorialist would represent that he believes it would be to the manifest advantage of the said Ward to have the said premises sold and the proceeds of such sale put at interest.  Your memorialist would further represent that there are claims existing against the Estate of said ward in favor of the Estate of David Davis deceased which claim holds a lien on said premises and if said claims should be sustained against the same it would require the sale of said premises to satisfy the same as the personal Estate of the said Richard which has come to the hands of your memorialist would be insufficient to pay the said claims.  Your memorialist therefore prays the Court would make an order for the appraisement and sale at private sale of the said premises and that the avails of the same may be applied as in this memorial requested.  And your memorialist will ever pray thus.

We the undersigned being called on to appraise the following described real Estate belonging to Richard Davis a minor. To wit a part of the East half of the South East quarter of Section five in Township Thirteen North of Range seven East Bounded as follows.  Commencing fifteen rods East of the South west corner of the Said half quarter, Thence running east Twenty one and Two thirds Rods, thence North fifty Three and Two thirds Rods, thence west twenty one & two thirds rods thence South fifty Three and two thirds rods to the place of beginning containing Seven acres and two ninths of an acre and we appraise the Same at five dollars and twenty five cents per acre making the Sum of Thirty Seven dollars and ninety Two cents.

         Personally appeared the above Named appraisers and makes oath that the above appraisment is Just and true to the best of their Judgment Sworn to this 31st Day of January 1845 before me Jesse Botton Justice of the peace within and for said County Signed: Jesse Botton J. P. Esquire To the Honorable William H. Sleeth Judge of the Probate Court of Shelby County. Greenberry Davis Guardian of the person and Estate of Richard Davis respectfully represents unto your honor that agreeable to an order of the Honorable Probate Court made at the February term thereof in the year 8145, he proceeded to make sale of the real estate in said order specified to wit a part of the East half of the South East quarter of section five in Township Thirteen North of Range Seven East, and bounded as follows to sit.  Commencing at a point fifteen rods East of the South West corner of Said half quarter thence running East twenty one and two third rods, thence North fifty three and two thirds rods, thence West twentyone and two thirds rods thence South fifty three and two thirds rods to the place of beginning.  Containing seven acres and two ninths of an acre, and sold the same at private sale to Hiram Fox for the sum of thirty seven dollars and ninety cents in cash and received the purchase Money that being the appraised value thereof and has executed to the same Hiram Fox a Deed of Conveyance for the same, which Deed is here now exhibited to the Court and made a part of this report, which said Deed and proceedings of said Guardian he prays your honor may duly confirm.  All which is respectfully submitted
