Last  Will  and  Testament
of
Ellen  A. Leech


            I,  Ellen A. Leech,  at this time a resident of the City of Shelbyville, Shelby County, Indiana, do hereby make and publish this my last will and testament, hereby revoking any and all other wills by me heretofore made.

            Item 1.  I direct that as soon as possible after my decease all of my just debts and funeral expenses be paid out of my estate by my executrix hereinafter named.

            Item 2.  I give, devise and bequeath to each of my two sons, John W. Leech and Frank Leech, the sum of One hundred Dollars, said sum to be paid to each of them out of my estate.

            Item 3.  I give, devise and bequeath all of the residue of my estate, both real and personal, that shall remain after the payment of my just debts and funeral expenses and bequests as provided for in item two above, to my daughter, Callie Leech, to have and to hold as her individual property forever in fee simple.

            Item 4.  I do hereby constitute and appoint my daughter, Callie Leech, executrix of this my last will and testament.

            In Witness whereof I have hereunto set my hand and seal this 24th day of May 1909.

            Signed, sealed and acknowledged by the above named Ellen A. Leech as her last will and testament in our presence and signed by us as attesting witnesses thereto, at her request, in her presence and in the presence of each other, this May 24th 1909.

            Be it remembered, that on the 28th day of June A.D., 1916 the ______Judicial day of the May Term, of the Shelby Circuit Court in said year, come into open Court Callie Leech and produces in Court an instrument in writing purporting to be the last Will and Testament of Ellen A. Leech, deceased, and now moved the admittance thereof to probate and record, and in proof of said Will introduces Everet E. Stroup the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say:     That on the 24th day of May 1909 he saw the said Ellen A. Leech sign her name to said instrument in writing as and for her last Will and Testament, and that this deponent, at the same time, heard the said Ellen A. Leech declare the said instrument in writing to be her last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Ellen A. Leech and with her consent attested and subscribed by the said Everet E. Stroup and John Horst in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Ellen A. Leech was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

            Whereupon it is ordered, adjudged and decreed by the Court that the said instrument in writing purporting to be the last Will of Ellen A. Leech deceased, is the Last Will and Testament of Ellen A. Leech deceased, and is hereby admitted to probate and record in this Court.

            I, Cecil B. Collins Clerk of the Circuit Court of Shelby County, Indiana ,do hereby certify that the within annexed Will and Testament of Ellen A. Leech, has been duly admitted to probate, and duly proved by the testimony of Everet E. Stroup one of the subscribing witness thereto, that a complete record of said Will, and of the testimony of the said Everet E. Stroup in proof thereof, has been by me duly made and recorded in Book 7 at Pages 139 and 140 of the record of Wills of said County.

            In Attestation Whereof, I have hereunto Subscribed my name, and affixed the seal of said Court, at Shelbyville, Indiana, this 28th day of June 1916.
