Last  Will  &  Testament

Emma   Messick,
deceased


Book 7 Pages 261 and 262


          I   Emma Messick,  of Shelbyville, Shelby County, Ind. do make, declare and publish the following as my last will.

Item 1.  I will and direct that all of my just debts, funeral expenses and the expenses of administration of my estate be first paid out of property other than that described in Item 2. of this will.

Item 2.  I will and bequeath to my niece  Prudence Winterrowd  all of the household goods and furniture, ornaments, bric-a-brac, dishes, silverware and personal property of every kind contained in my residence and used by me in keeping house therein, and also all articles of jewelry, wearing apparel and personal ornaments owned by me, none of which shall be sold by my Executor but all of which shall be delivered to her by him.

Item 3.  I will and bequeath to my nephew,  William Winterrowd,  the sum of one Thousand Dollars.

Item 4.  I will and Bequeath to  Charles Billingsley  of Shelbyville, Indiana the sum of fifty Dollars.

Item 5.  I will and bequeath to  Mrs. Albert Mutchler  of Coffeville, Kansas the sum of One Hundred Dollars.

Item 6.  I will and bequeath to the City of Shelbyville, Indiana to be used in sitting up and furnishing a City Hospital the sum of Three Hundred Dollars.

Item 7.  I will devise and bequeath all of the residue of my estate to my Niece Prudence Winterrowd mentioned in Item 2 of this will the same to be owned and held by her absolutely.

Item 8.  I nominate and appoint  Harry C. Morrison  of Shelbyville, Indiana as Executor of this as my last will.

In witness whereof I have hereunto set my hand and seal this 13th day of September, 1916.

The annexed Instrument was signed, sealed and acknowledged by the said Emma Messick as her last Will in our presence, and signed by us as attesting witnesses thereto, at her request in her presence and in the presence of each other, this 13th day of September, 1916.

          Be it remembered that on the 1st day of October, A. D. 1917 the 1st judicial day of the October Term of the Shelby Circuit Court in said year, come into open court H. C. Morrison and produces in Court an instrument in writing purporting to be the last will and testament of Emma Messick, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces Charles W. Culbertson, the subscribing witness thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testifies as follows:  That is to say: that on the 13th day of Sept. 1916 he say the said Emma Messick sign her name to said instrument in writing as and for her last Will and Testament; and that this deponent, at the same time, heard the said Emma Messick declare the said instrument in writing to be her last will and testament, and that the said instrument in writing was at the same time, at the request of the said Emma Messick and with her consent attested and subscribed by the said Charles W. Culbertson and Lewis E. Goodrich in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto and that the said Emma Messick was, at the time of the signing and subscribing of said instrument in writing, as aforesaid, of full age, (that is, more than twenty one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not

whereupon it is ordered, adjudged and decreed by the court that said instruemtn (sic) in writing purporting to be the last will of emma Messick deceased, is the last Will and testament of Emma Messick Deceased, and is hereby admitted to probate and record in this Court.

                    I, Cecil B. Collins, Clerk of the Circuit court of Shelby County, Indiana, do hereby certify that the within annexed will and Testament of Emma Messick has been duly admitted to probate and duly proved by the testimony of Charles W. Culbertson on of the subscribing witnesses thereto, that a complete record of said will, and of the testimony of said Charles W. Culbertson in proof thereof her been by me duly made and recorded in Book 7 at pages 261 and 262 of the record of Wills of said County.
IN  ATTESTATION  WHEREOF I have hereunto subscribed my name and affixed the seal of said court, at Shelbyville, Indiana, this 1st day of October, 1917
