Last Will and Testament
of
Fountain Huffman


"In the name of the Benevolent Father of All:  I, Fountain Huffman of Shelby County in the State of Indiana, do make and publish this my last Will and Testament."

"ITEM FIRST--I will and direct that after my decease all my just debts and funeral expenses be paid out of my personal estate."

"ITEM SECOND--I give will and devise and bequeath to my beloved wife  Hannah Huffman, in lieu of the interest she now has and will have at and by my decease in the Real Estate and personal property of which I shall be owner at my decease as my wife and widow under the laws of the State of Indiana, all the Real Estate of which I shall be owner at my decease and all the personal property that I shall own at my decease except the money I shall then have on hand and the money demands that shall then be owing to me to have and to hold for and during the time of her natural life and for that time only."

"ITEM THIRD--I give will and bequeath to my said wife Hannah Huffman all the interest that will accrue on the money that I shall own and have on hand at my decease for and during the residue of her natural life and also the interest that shall accrue on all moneys that shall be owing to me at my decease for and during the residue of her natural life from the time of my decease, and I hereby direct that the Executor or Adminstrator with this will annexed, shall as soon as practicable after my decease, pay my just debts and funeral expenses out of my personal estate and that he or she collect all the money that shall be owing to my estate, and after payment of my just debts and funeral expenses, loan out and keep loaned out at interest payable at least annually with good security all the moneys I shall have on hands at my decease, after payment of my debts and funeral expenses, and keep the same so loaned out at interest for and during the residue of the natural life of my beloved wife Hannah Huffman, and to pay and deliver to her own money the interest that shall accrue thereon as he or she may collect the same from the time of my decease to the time of her decease."

"ITEM FOURTH--As soon after the decease of my widow Hannah Huffman as practicable, I will and direct that my executor shall sell all the Real Estate of which I shall bethe owner at my decease for cash or upon such reasonable payments as he may deem most advisable, empowering and authorizing him to make such sale and conveyance of such lands as such executor to be disposed of by him as such Executor hereinafter named."

"ITEM FIFTH--I will and bequeath at the death of my wife Hannah Huffman to my two grandchildren  Hannah M. Lee  and  Emma Lee  the sum of six hundred dollars each, and in the event that either of them shall die leaving no children nor descendant of children before the death of my wife Hannah Huffman, then and in that event, the six hundred dollars herein bequeathed to such deceased grandchild I hereby will and bequeath at the death of my wife Hannah Huffman to the other of the two said grandchildren, and in the event that both of said grandchildren shall die before the death of my wife Hannah Huffman, having neither children nor descendants of children, then and in that event, I will and bequeath said Twelve Hundred dollars at the death of my wife Hannah Huffman to my five children,  Ira Huffman,  William R. Huffman,  Fountain J. Huffman,  Gideon Huffman,  and  John L. Huffman, share and share alike, and if any of said children shall die before the death of my wife Hannah Huffman leaving neither wife nor children nor descendants of children, then the share of said Twelve Hundred dollars herein willed to such deceased child or children I hereby at the death of my wife Hannah Huffman will to each of said five children as may then be living in equal proportions.  And I further will and direct that if at the death of my wife Hannah Huffman any of said five children shall have before that time died leaving children or descendants of children that the said share of said Twelve Hundred dollars herein willed to such child or children shall at the death of my wife Hannah Huffman go to the descendants of such deceased child or children."

"ITEM SIXTH--At the decease of my said wife Hannah Huffman, I will and bequeath to my son  Ira Huffman  the sum of four hundred dollars."

"ITEM SEVENTH--At the death of my wife Hannah Huffman, I will and bequeath to my grandaughter  Clara Derringer  the sum of Five Hundred Dollars and if she shall die before the death of my wife Hannah Huffman leaving lawful children or their descendants at the death of said Hannah Huffman, I will and bequeath said Five Hundred Dollars to such children or descendants, but in the event my said grandaughter shall die before the death of my said wife Hannah Huffman leaving neither children nor their descendants, then at the death of said Hannah Huffman, I will the said Five Hundred Dollars to my five children,  Ira Huffman,  William R. Huffman,  Fountain J. Huffman,  Gideon H. Huffman,  and  John L. Huffman,  share and share alike, upon the same conditions and subject to the same qualifications and restrictions as set forth in Item number Fifth as to the twelve hundred dollars therein mentioned."

"ITEM EIGHTH--After the payment of all the amounts as herein above stated, all the residue of my estate, including what may be left of the proceeds of the sale of my lands, I will and bequeath, at the death of my wife Hannah Huffman, to my said five children, Ira Huffman, William R. Huffman, Fountain J. Huffman, Gideon H. Huffman, and John L. Huffman in equal shares and proportions, and if my said children shall die before the decease of my wife Hannah Huffman, leaving neither children nor descendants of said children, then I will that at the death of my wife Hannah Huffman, the share or shares so willed to such deceased child or children shall, at the death of said Hannah Huffman, go and belong in equal proportions to each of said children as may be living at the death of said Hannah Huffman and to the descendants of any of such five children as may have died before the decease of said Hannah Huffman, having such descendants alive at her death, such descendants taking the share that would have belonged to such deceased child if then living, and if any of said five children shall die before the death of said Hannah Huffman, then such descendants shall take the share that such deceased child would then have taken if living."

"ITEM NINTH--I hereby revoke all former wills by me heretofore at any time made."

"ITEM TENTH--I hereby nominate and appoint  St. Clair Ensminger  as Executor of this my last Will and Testament."

"In witness whereof I have hereto set my hand and seal at Shelbyville, Indiana, on the 26th day of April, 1883."

"Signed and acknowledged by the above named Fountain Huffman as his last will and testament in our presence and signed by us attesting witnesses thereto in his presence and in the presence of each other this 26th day of April, 1883.   Henry Doble,  John Messick"
