John  McCartney's  Last  Will


Flat Rock, Ind. April 6th 1905.

          A Request and will of  John McCartney made this sixth day of April 1905.  Is that my body after death shall be prepared for burial by John J. White (of the firm of Hageman & White) the expense thereof not to exceed Eighty Dollars.  It is my desire that there be no funeral services only that my remains when taken from my late home shall be taken direct to the grave, and after all of my lawful debts are paid the residue of all my property which consists of  House and Lot in the town of Flat Rock, Ind.  Also Household goods & Money if any shall go equally to James McCartney and Elizabeth McCartney it is my request that  L. G. Almroth shall be the Administrator to settle up all the business strictly as is this my last Request. Signed by me this 6th day of April 1905

                Be it remembered.  That on the 20 day of September 1905  John J. White one of the subscribing witnesses to the within and foregoing last Will and Testament of  John McCartney, late of said County, personally appeared before the Clerk of the Circuit Court of Shelby County, in the State of Indiana, and being duly sworn by the Clerk of said Court, upon his oath, declared and testified as follows, that is to say:   That on the 6th day of April 1905 he saw the said John McCartney sign his name to said instrument in writing as and for his last Will and Testament and that on this deponent at the same time, heard the said John McCartney declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was, at the same time, at the request of the said John McCartney and with his consent attested and subscribed by the said  John J. White and  David Compton in the presence of said Testator, and in the presence of each other as subscribing witnesses thereto, and that the said John McCartney was at the time of the signing and subscribing of said instrument in writing, as aforesaid of full age (that is, more than twenty one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes and further deponent says not.

Sullivan Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of John McCartney has been duly admitted to probate, and duly proved by the testimony of John J. White one of the subscribing witnesses thereto, that a complete record of said Will, and of the testimony of the said  John J. White in proof thereof, has been by me duly made and recorded in Book 4 at Pages 534 and 535 of the record of Wills of said County In Attestation Whereof, I have hereunto subscribed my name, and affixed the seal of said Court, at Shelbyville, this 20th day of September 1905
