 Theora  Gonce


I, Theora A. Gonce, of Shelby County, Indiana, do make and publish this, my Last Will and Testament, and do hereby revoke any and all former Wills by me at any time heretofore made.

          Item lst:  I hereby nominate Edward H. Chadwick, of Shelbyville, Indiana, to be the Executor of this will.

          Item 2d:  I direct that all just debts owing by me at the time of my death, and the expenses of my funeral be paid out of the first moneys owing into the hands of said Executor from my estate.

          Item 3d:  It is my will and I do hereby expressly direct that my said Executor shall sell all real estate owned by me, in the manner provided by law, and convert all personal property belonging to me, at the time of my death, into cash assetts, all as soon as practicable after my death.  Out of the moneys thus coming into the hands of said Executor, after paying all just debts and liabilities against me and against my estate he, said Executor shall pay to my husband, John Gonce, should he survive me, the sum of One Hundred Dollars ($100), which shall be paid to him and accepted by him in full and in heir of all his statutory rights in my estate.  And after the above payment has been made to and accepted by my said husband, my said Executor shall divide the residue of moneys in his hands as such Executor into seven equal shares; and one of said equal shares he shall pay to my daughter, Elva Justus;  and one equal share he shall pay to my son,  Lewis Melvin Billman;  and a third equal share he shall pay to my daughter,  Sarah Margaret Parcel; a  fourth equal share he shall pay to my daughter  Mattie Swafford,  a fifth equal share he shall pay to my son  Harrison Wells;  a sixth equal share he shall pay to my son, Charles Roy Wells;  and the seventh equal share he shall pay to my youngest child, Blanche McCormack.

          I trust that all the legatees under this will shall accept the above bequests and abide by this disposition of my property, as right and just.
          In witness thereof I have hereunto set my hand and seal this 27th day of Janaury, A.D. 1911.

          On the 27th day of January, 1911, at the home of said above named Testatrix, in our presence and hearing she, Theora A. Gonce well known to us, signed and sealed the foregoing instrument and declared the same to be her last Will and Testament; and at the same time and place, in the presence of said Testatrix, and at her request, and in the presence of each other, we, the undersigned hereunto subscribed our names as Witnessess to and of the foregoing Will.

          Be it Remembered, that on the 20th day of June, A.D., 1911 the 20th judicial day of the May Term of the Shelby Circuit Court in said year, come into open Court Edward H. Chadwick and produces in Court an instrument purporting to be the last Will and Testament of Theora A. Gonce, deceased, and now moves the admittance thereof to probate and record, and in proof of said Will introduces, William H. Phares, one of the subscribing witnesses thereto, who being duly sworn by the Clerk of said Court, on oath, declare and testify as follows, that is to say:  That on the 27th day of January, 1911 he saw the said Theora A. Gonce sign her name to said instrument in writing as and for her last Will and Testament; and that this deponent, at the same time, heard the said Theora A. Gonce declare the said instrument in writing to be her last Will and Testament, and that the said instrument in writing was, at the same time, at the request of the said Theora A. Gonce and with her consent attested and subscribed by the said deponent, Wm. H. Phares, and One Johnathan G. Wright, in the presence of said testator, and in the presence of each other, as subscribing witnesses thereto, and that the said Theora A. Gonce was, at the time of the signing and subscribing of said instrument in writing as aforesaid, of full age (that is, more than twenty-one years of age) and of sound and disposing mind and memory, and not under any coercion or restraint, as the said deponent verily believes, and further deponent says not.

          Whereupon it is ordered, adjudged and decreed by the Court that said instrument in writing purporting to be the last will of Theora A. Gonce, deceased, is the last Will and Testament of Theora A. Gonce, deceased, and is hereby admitted to probate and record in this Court.

          I, Otto L. Coyle, Clerk of the Circuit Court of Shelby County, Indiana, do hereby certify that the within annexed Will and Testament of Theora A. Gonce deceased has been duly admitted to probate, and duly proved by the testimony of William H. Phares, one of the subscribing witnesses thereto, that a complete record of said Will, and of testimony of the said Wm. H. Phares, in proof thereof, has been by me duly made and recorded in Book 6 at pages 36 & 37 of the Record of Wills of said County. In attestation thereof I have subscribed my name and affixed the seal of said Court, at Shelbyville, Indiana this 20th day of June, 1911.

Acceptance of  John Gonce

          I, John Gonce, having heard read over the last will and testament of my late wife, Theora A. Gonce, now admitted to Probate in the Circuit Court of Shelby County, Indiana, and duly recorded, with the proof thereof, in Will Record "No. 6" on pages 36 & 37, in the office of the Clerk of said Court, and being fully advised of the force and effect of said will, do now and hereby elect and Accept under said Will and under the provisions thereof, and hereby agree and covenant to abide by said will and all the provisions thereof, and hereby accept the provisions of said will in my behalf instead and in lieu of all my rights in the estate of my said deceased wife under the Statures of the State of Indiana In witness whereof I have hereunto set my hand and seal this 20th day of June, A.D., 1911.

          Before me the undersigned, this 20th day of June, 1911, personally came the within named John Gonce and acknowledged the execution of the foregoing instrument at his election under the Will of Theora A. Gonce, dec'd.
